# Intellectual Property & Licensing Risk Assessment
## The Problem
Using popular character brands (Sonic, Frozen, Paw Patrol) as worksheet themes carries significant IP/licensing risk. This document outlines the risks and the recommended approach.
## Risk Levels by Approach
### ❌ HIGH RISK: Direct Character Use
- Using official character images, names, or logos
- Creating worksheets titled "Paw Patrol Math" or "Frozen Addition"
- This WILL result in takedown notices and potential legal action
- **Never do this.**
### ⚠️ MEDIUM RISK: Fan Art / Inspired Characters
- Creating original illustrations "inspired by" popular characters
- Using similar color schemes, settings, or aesthetics without named characters
- Risk depends on how closely the art resembles the original
- **Grey area — potentially defensible but risky at scale.**
### ✅ LOW RISK: Genre-Based Themes (RECOMMENDED)
- Creating original themed worlds that capture the same appeal:
- Instead of "Paw Patrol" → **"Puppy Rescue Squad"** — original rescue puppy characters
- Instead of "Frozen" → **"Ice Kingdom Adventure"** — original ice princess and snow creatures
- Instead of "Sonic" → **"Speed Runner"** — original fast animal character in colorful worlds
- Instead of "No Man's Sky" → **"Star Explorer"** — original space exploration theme (already done!)
- Children are attracted to the GENRE (space, puppies, ice magic, speed) not the specific brand
- This approach is legally safe and creatively unlimited
## Recommended Strategy
### 1. Build Original Theme Library
Create a library of original visual themes based on popular genres:

### 2. Marketing Language
- **DO say:** "Space-themed worksheets" / "Worksheets for kids who love puppies and rescue adventures"
- **DON'T say:** "Paw Patrol worksheets" / "Frozen math activities"
- **DO say:** "Themed to match your child's interests"
- **DON'T say:** "Your child's favorite characters"
### 3. Custom Orders
When parents request "my child loves Paw Patrol," create a "rescue puppies" theme that captures the genre appeal without infringing IP. Most parents care about the *type* of content (cute dogs doing heroic things), not the specific brand.
### 4. Platform Compliance
- Pinterest, Instagram, Teachers Pay Teachers all enforce IP policies
- Using brand names in descriptions/tags can result in content removal
- Original themed content has no platform restrictions
## Exception: Public Domain & Creative Commons
Some themes are IP-free:
- Classic fairy tales (Cinderella, Snow White — the original stories, not Disney versions)
- Dinosaurs, space, ocean, nature — no IP owner
- Generic fantasy (dragons, unicorns, wizards)
- Historical themes (pirates, knights, explorers)
These can be used freely without any restrictions.
## Action Items
- [ ] Develop 3-4 original theme visual libraries (beyond space)
- [ ] Create theme naming guide for consistent branding
- [ ] Draft parent-facing FAQ about themes ("We create original themed worlds inspired by genres your children love")
- [ ] Never use trademarked character names in file names, metadata, or marketing materials
